The conditions governing access to and use of the Chibo Dev website. By browsing it, you agree to these terms.
These Terms of Use govern access to and use of the Chibo Dev website. By accessing or browsing this site, you declare that you have read, understood and fully agree with the conditions set out below. If you do not agree, we recommend that you do not use the site.
1. Acceptance of the Terms
Using this site implies acceptance of these Terms of Use.
The Privacy Policy and the Cookie Policy are informational: they explain how I handle your data and do not depend on your acceptance to be valid. Where the processing does depend on your consent — measurement cookies and functionality cookies —, it is collected in the notice, separated by category, and can be withdrawn at any time under Cookie preferences, in the footer. Browsing the site does not count as consent.
These Terms may be updated. The version in force is always the one published on this page, with the date at the top.
2. About the site
The Chibo Dev site is a company and portfolio website. Its purpose is to present front-end development and web design work, completed projects and contact channels for visitors, clients and prospective clients, in Brazil and abroad.
This site is operated by Yuri Chiba, an independent developer based in São Paulo/SP, Brazil, working under the name Chibo Dev. There is no company behind the brand: it is me.
For anything concerning these Terms or the handling of your data, the channel is the e-mail address chibo.developer@gmail.com. Full identification details are stated in the commercial proposal and are given to anyone who requests them at that address.
3. Conditions of use
When using the site, you undertake to do so lawfully and in good faith. Among other conduct, it is prohibited to:
- Use the site for unlawful purposes or in ways that infringe third-party rights;
- Attempt to gain unauthorised access to systems, servers or data;
- Introduce viruses, malicious code or anything that harms the operation of the site;
- Copy, reproduce or reuse site content without permission, as set out in the intellectual property section.
4. Intellectual property
All content on this site — including text, layout, design, code, visual identity and other elements — is owned by or licensed to Chibo Dev, and is protected by intellectual property law. Reproduction, distribution or use without prior written permission is not allowed.
The project images and references shown in the work section belong to the respective clients and are presented for portfolio purposes only. Third-party trademarks, logos and names belong to their respective owners.
This section covers the content of this site and does not apply to what I deliver in contracted projects. Ownership of, and the licence over, the design, the code and the files produced for each client are set out in writing in the proposal or in the contract for that project, as required by Brazilian Copyright Law (Law No. 9,610/1998). In the absence of a written provision, the economic rights remain with me and the client receives a licence to use the delivered material for the purpose of the project.
The domain and the service accounts registered in the client's name are theirs and remain theirs. I reserve the right to show delivered work in my portfolio, unless otherwise agreed.
5. Informational content
The scope, the timeline and the price of each project are settled individually in the proposal. The ranges and examples quoted on the site are for reference and do not replace the proposal.
What I state precisely, however, holds. The guarantees announced on this site — a reply within 24 hours, 30 days of support included after delivery, domain and accounts registered in the client's name — become part of the contract when you hire me, as article 30 of the Brazilian Consumer Protection Code (Código de Defesa do Consumidor) determines. If I stop being able to stand behind any of them, I take it off the site before I stop honouring it.
For the rest of the content, I do my best to keep everything correct and up to date, but the occasional error or omission can happen and does not count as a promise to the contrary.
6. Limitation of liability
This site is a company website and is provided as is. I do not guarantee uninterrupted availability or the absence of faults: there may be interruptions for maintenance or because of a hosting problem.
I am not answerable for the content, the availability or the privacy practices of third-party sites reached through links from here, nor for damage arising exclusively from misuse of the site or from a fault in your equipment or your connection.
Nothing in this section removes my liability for wilful misconduct or negligence, for a defect or fault in a service I provide, nor the rights the Brazilian Consumer Protection Code guarantees you. Any clause excluding or reducing that liability is void, and that is not what is written here.
7. Third-party links and services
The site may contain links to third-party sites and services (such as WhatsApp and social networks) and use external services to operate. Chibo Dev does not control and is not responsible for the content, privacy practices or availability of those third parties. Accessing them is at your own risk and subject to their own terms and policies.
8. Privacy and data
The processing of personal data carried out through this site is governed by our Privacy Policy and our Cookie Policy, in compliance with the Brazilian General Data Protection Law (LGPD). By using the site, you acknowledge that you are aware of these practices.
9. Changes to the Terms
I may change these Terms at any time, to keep up with changes in legislation or in how the site works. The version in force is always the one published on this page, with the last-updated date at the top, and it applies from publication onwards — with no retroactive effect.
These Terms govern only the use of this site. A contracted project is governed by the proposal and the contract for that project, which I do not change unilaterally once they are closed.
10. Governing law and jurisdiction
These Terms are governed by Brazilian law.
If the dispute involves a consumer relationship, the courts of your own domicile are guaranteed to you, in the manner set out in the Brazilian Consumer Protection Code. If you are outside Brazil, the consumer protection rules of your country of residence continue to apply as far as they are applicable.
In all other cases, the courts of the District of São Paulo/SP, Brazil, are elected.
